Child’s guardianship (custody) in a household

The household is a legal entity that takes care of the rights and interests of children deprived of parental care and protection in the family environment.

Child’s guardianship (custody) in a household means a legal entity registered in the Register of Legal Entities the operation of which is aimed at ensuring the interests of four or more (but not more than eight, counting with their own children) children under guardianship (custody) in a family environment. The state and municipality or other institutions, companies or even natural persons may more easily allocate financing, child support funds, targeted financial and material support to legal entities. Everyone benefits from such activities: the child is cared for in a family-close environment, it becomes simpler and easier for the household itself to ensure the interests of the children under guardianship (custody).

What are the duties of the household?

The duties of the household members include the organisation of the household’s activities the main concern of which is the guardianship (custody) of the child. The household has the duty and responsibility to take care of the child, ensure his needs, and provide a safe environment. As a legal entity, the household must provide data and documents about the household to the Register of Legal Entities, prepare reports and information, store documents and other information related to the household.

 

Who can register a household?

The founder of the household may be an adult over 21 years old. You must meet the conditions stipulated in the Republic of Lithuania Law on Households: be properly prepared to care for children, be healthy, have no problems with law enforcement. It is also important that you were not deprived of your rights to guardianship of children and your rights to guardianship of children were not restricted.

 

What is the difference between the household and other forms of child guardianship?

Child’s guardianship (custody) in the family is fundamentally different from other forms of guardianship in terms of legal regulation.

The State encourages the guardianship (custody) of children in the family environment, therefore, encourages the registration of the family as a legal unit, provides it with considerable financial and other material incentives and allows guardianship (custody) together with one’s own children.

Application to the mayor of the municipality
Approval of the articles of association of the household
Obtaining of the conclusion
Registration in the Register of Legal Entities
End of the household establishment process

Each guardian, custodian, founder or member of a household has access to assistance and support from the Guardianship Centre. All services of the Guardianship Centre are free of charge and are provided throughout the entire guardianship process from training to guardianship (custody).
